These Terms of Service ("Terms") govern your use of the Texas Local Rules Engine ("the Service"), operated by Pharmakon ("we," "us," "our"), accessible at pharmakon.legal and pharmakon.io.

By subscribing to or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

The Texas Local Rules Engine is a subscription-based search tool that allows you to query a structured database of Texas court local rules, standing orders, and judicial preferences across 175 Texas counties. The Service is delivered as a .skill file for Claude Desktop that connects to our hosted database.

What the Service Is NOT

The Service does not constitute legal advice. It is a research and reference tool. The information provided reflects court rules as of the database's last update date. Court rules change. Standing orders are amended. Judges retire and are replaced.

You must independently verify all rules with the relevant court before relying on them for any filing, deadline, or procedural decision. We are not responsible for actions taken based on information retrieved from the Service without independent verification.

Pricing

All prices are in U.S. dollars. Prices may change with 30 days' notice.

Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription rate at each renewal. This is a recurring charge.

Payment Processing

All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your selected payment method on a recurring basis. We do not store your credit card information.

Public Domain Content

The underlying text of Texas court rules, statutes, standing orders, and judicial preferences is public domain government work. Our IP lies in the collection, structuring, indexing, and delivery of that content — not the content itself.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make reasonable efforts to keep the database current and accurate. However, court rules change without notice, and errors in data extraction may occur. You are solely responsible for verifying the accuracy and currency of any rule before relying on it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHARMAKON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES ARISING FROM MISSED DEADLINES, REJECTED FILINGS, OR SANCTIONS RESULTING FROM RELIANCE ON INFORMATION FROM THE SERVICE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Pharmakon from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your reliance on information from the Service without independent verification.

10. Termination

You may cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or your payment cannot be collected. Upon termination, your API key is revoked and the .skill file stops functioning.

11. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Dallas County, Texas. Before filing any claim, you agree to attempt informal resolution by contacting us.

12. Changes to These Terms

We may update these Terms with 30 days' notice by email. Your continued use after the effective date constitutes acceptance. If you do not agree, you may cancel your subscription.
